1. Acceptance of Terms
By accessing or using the StockUp platform ("StockUp", "we", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.
2. NOT FINANCIAL ADVICE
StockUp is an educational and informational tool, not a registered broker, investment advisor, or financial planner.
- None of the data, AI analyses, text, or charts provided on this platform constitute a recommendation to buy, sell, or hold any security or financial product.
- You are solely responsible for your own investment decisions. We strongly advise consulting with a licensed financial professional. StockUp is not liable for any financial losses incurred while using our platform.
3. STOCKUP COPILOT & AI RISK DISCLAIMER
StockUp Copilot and AI Report features utilize Artificial Intelligence (AI) — specifically Google's Gemini model — to summarize news, analyze stock data, and generate market overviews.
- AI is prone to errors, hallucinations, and outdated context. The AI does not predict future market movements with any guarantee of accuracy.
- The verdicts, summaries, and chat responses generated are based on available data at the time of the request. They are not human-verified financial recommendations.
- Copilot's output must never be used as the sole basis for an investment decision.
- AI responses may reflect the AI model's training biases. StockUp does not endorse any specific stock, sector, or investment strategy suggested by the AI.
- Deep Research mode uses live Google Search results to inform responses. StockUp is not responsible for the accuracy or completeness of third-party content surfaced by the AI.
4. AI Usage Limits & Fair Use
To ensure platform stability and fair access, AI features are subject to daily usage limits depending on your subscription tier.
- Free plan users do not have access to AI Report or Copilot features.
- Essentials plan users are limited to 10 AI Reports and 15 Copilot conversations per calendar day (UTC). Unused limits do not roll over.
- Pro plan users have unlimited AI access subject to reasonable fair use. We reserve the right to throttle or suspend accounts that generate automated or abusive volumes of AI requests.
- StockUp is not liable for any service degradation caused by upstream AI provider outages or rate limits imposed by Google.
5. Data Processing & Third-Party AI
When you use Copilot or AI Report features, certain data is transmitted to Google's Gemini API servers for processing.
- This data may include: the stock ticker you are analyzing, publicly available financial metrics, recent news headlines, and the text of your chat messages.
- Do not submit personal financial information, account numbers, social security numbers, or any sensitive personal data through Copilot.
- Your data is processed according to Google's Privacy Policy. By using AI features, you consent to this processing.
- StockUp does not permanently store the content of your Copilot conversations. Chat history is session-only and is cleared when you close the Copilot panel.
- Your Firebase account data (email, tier, usage counters) is stored securely in Google Firestore and is never sold to third parties.
6. Market Data & Third-Party Services
StockUp aggregates data using third-party providers, primarily TradingView and Finnhub.
- We do not guarantee the accuracy, completeness, or timeliness of pricing data, news feeds, or charting information.
- If TradingView or Finnhub experience downtime, parts of StockUp will also experience downtime. We are not liable for trading losses caused by data latency or third-party outages.
7. "Bring Your Own Key" (BYOK) Policy
To access live search data, StockUp requires users to input their own personal Finnhub API Key.
- You are entirely responsible for maintaining the security of your API key and abiding by Finnhub's own Terms of Service.
- StockUp stores your API key in your Firebase account to enable live data features. It is never shared with third parties outside of requests made on your behalf to Finnhub.
- StockUp is not responsible if your API key is rate-limited, revoked, or banned by Finnhub.
8. Subscriptions, Billing, and Cancellations
StockUp offers paid subscription tiers billed securely via Stripe.
- Subscriptions are billed automatically on a recurring monthly basis.
- You may cancel your subscription at any time via your Profile dashboard. Cancellation takes effect at the end of the current billing period.
- Because of the immediate cost of AI generation incurred at the time of each request, we do not offer prorated refunds for partially used billing periods.
- StockUp reserves the right to modify pricing with 30 days' notice to active subscribers.
9. Prohibited Use
You agree not to use StockUp for any of the following:
- Automated scraping, botting, or mass querying of any AI or data features.
- Reselling, redistributing, or republishing AI-generated content as professional financial advice.
- Attempting to reverse-engineer, extract, or expose the system prompts or internal logic of StockUp Copilot.
- Any use that violates applicable securities laws or regulations in your jurisdiction.
10. Limitation of Liability
To the fullest extent permitted by law, StockUp, its owners, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to investment losses, data inaccuracies, or AI-generated misinformation.
11. Changes to Terms
We may update these Terms at any time. Continued use of StockUp after changes are posted constitutes acceptance of the new Terms. We will update the "Last Updated" date at the top of this document when changes are made.
